Terms and Condition

1. Overview

These Terms and Conditions apply to the use of the indoor soccer and padel-tennis facilities operated by Sports Arena Ltd (“Operator”) at Trianon under the “Sports Arena” name. By accessing and using these facilities, all participants and users (“Users”) agree to comply with these Terms and Conditions.

2. Booking and Payments

2.1 Bookings:

All bookings must be made online or in person at the facility. Bookings are allocated on a first-come, first-served basis, and full payment is required at the time of booking. Group or party bookings should be made in advance, and any modifications must be communicated to the Operator as early as possible.

2.2 Payment Terms:

Payment must be made in full at the time of booking unless otherwise arranged with the Operator. Cash, credit/debit cards, and online payments through our booking system are accepted. Payment by cheques shall be accepted on an exceptional basis and at the Operator’s discretion.

2.3 Refunds and Cancellations:

  • Cancellations by Subscriber: Once time slots are booked, no refunds shall be granted to the Subscriber for any reason whatsoever in case of cancellation or no-show.
  • Cancellations by the Operator: The Operator reserves the right to cancel or reschedule bookings due to unforeseen circumstances, such as maintenance works, adverse weather conditions, or safety concerns. In such cases, the User will be offered alternative time slots based on availability as informed by the Operator.

3. Use of Facilities

3.1 Facility Access:

Users are required to arrive at least 10 minutes before the booked session begins. Late arrivals may result in shortened sessions, and no compensation will be provided to Users for missed time.

3.2 Conduct and Equipment:

  • Users must wear appropriate sports attire, including non-marking shoes reserved for indoor use. No footwear with spikes or studs are allowed. The Operator reserves the right to ban access to a User making use of inadequate footwear without a refund.
  • No outside footwear is allowed on the courts.
  • Equipment provided by the Operator, such as soccer balls or padel rackets, must be returned in good condition after use. Any damage to the equipment caused by the User may result in additional charges.
  • Users are expected to behave respectfully and courteously towards others. The Operator, acting through its préposés, reserves the right to remove from the premises anyone engaging in abusive or inappropriate conduct without a refund.

3.3 Prohibited items and Activities:

  • Smoking, alcohol and illegal substances are strictly prohibited on the premises.
  • No food or drinks, except for unsweetened water, are allowed in the playing areas.
  • Users must not engage in any dangerous or reckless behaviour that could pose a risk to themselves or others.
  • Including but not limited to: Tackles, high kicks, raised feet, charging or body checks, reckless challenges, pushing or pulling, excessive use of elbows or arms, threats, goalkeeper collision, spitting, kicking or punching, clinging onto goal post, clinging onto net.
  • Including but not limited to: Reckless swinging, hitting players with paddle, over aggressive net rushes or collision, hitting the ball on the opponent intentionally, running into walls, fence or glass, throwing the paddle, verbal abuse and threat, playing while unfit, using inappropriate equipment, jumping/standing on net, climbing/clinging onto fence.
  • Running into, body charge or smashing against rebound boards/glass.
  • No padlocks beyond the User session on locker cabinets. Such padlocks will be removed and disposed of including any items found in the locker cabinet.
  • No clinging, pulling or damaging of nets.
  • No standing on table, benches.
  • No pets or animals are permitted inside the facility.
  • No tampering with unauthorised equipment including hose reels and fire extinguishers.
  • Users shall not access unauthorised/restricted areas.
  • No littering

4. Age Restrictions and Supervision

4.1 Children and Minors:

  • Users under the age of 18 must be supervised by an adult at all times unless participating in an organized or supervised session provided by the Operator.
  • The Operator may offer specific time slots for children’s activities, during which special terms may apply.

5. Health and Safety

5.1 Personal Responsibility:

Users must ensure that they are physically fit and in good health before using the facilities. It is the responsibility of the User to consult a healthcare professional before engaging in physical activities if they have any underlying medical conditions.

5.2 Injuries and First Aid:

The Operator shall apply its best endeavours so that basic first aid supplies are made available at the front desk or any other suitable location in the Premises. However, neither the Operator nor its préposés shall be bound by any obligation de résultat in respect of the administration of any first aid or care to Users. However, Users participate at their own risk and should ensure they have appropriate insurance coverage.

5.3 Emergency Procedures:

Users must familiarize themselves with the facility’s emergency exits and procedures, which are clearly displayed throughout the premises.

6. Liability and Indemnity

6.1 User's Assumption of Risk:

Use of the facility is at the User’s own risk. The Operator shall not be liable for any injury, loss, or damage to personal property while using the facility unless such injury, loss, or damage is caused by the gross negligence of the Operator or its staff.

6.2 Indemnity:

The User agrees to indemnify and hold the Operator harmless from any claims arising from their use of the facilities, including, but not limited to, claims for injuries or damages to third parties caused by the User’s actions.

6.3 Personal Insurance:

Users are required to carry their own insurance for personal injury, loss, or damage. The Operator’s insurance does not cover individual Users’ property or personal injury during activities.

7. Facility Availability and Cancellations

7.1 Facility Availability:

The Operator reserves the right to make changes to the availability of the facility, including temporary closures for maintenance or events. Users will be informed of any changes as early as possible.

7.2 Extreme Weather or Unforeseen Events:

The Operator may cancel or postpone bookings in cases of extreme weather conditions or other unforeseen circumstances. Users will be offered alternative booking . time slots based on availability as informed by the Operator

8. Force Majeure

The Operator shall not be held liable for failure to provide services due to causes beyond its control, including but not limited to natural disasters, pandemics, governmental actions, power outages, or other events that make the facility unusable. In such cases, the Operator will offer Users alternative booking dates based on availability as informed by the Operator, but no further compensation will be provided.

9. Parking and Surrounding Facilities

Users park their vehicles at their own risk. The Operator is not responsible for any theft, loss, or damage to vehicles or personal property in the parking areas or surrounding facilities.

10. Memberships and Renewals

10.1

The Operator may offer memberships that provide access to the facilities under specific terms. Annual memberships are renewable subject to 3 months’ prior notice, so as to ensure availability of equivalent slots or as per the terms provided.

10.2

The Operator reserves the right to suspend or cancel memberships for violations of these terms or misuse of the facilities.

10.3

Refunds will not be provided for suspended or cancelled memberships.

11. Photography and Meda Use

Photography or video recording by Users may be restricted in certain areas (e.g. player boxes), as per the applicable House Rules. By entering or using the Facility, all Users irrevocably consent to the use of their image (in whatsoever form or format) and likeness by the Operator and they waive all Intellectual Property Rights over same.

12. Suspension or Termination of Use

The Operator reserves the right to suspend or terminate a User’s access to the facility if the User breaches these terms or engages in unsafe or inappropriate behaviour. In cases of suspension or termination, no refunds will be provided.

13. Damage to Equipment or Facilities

Users will be responsible for any damage caused to equipment or facilities due to improper use. Users will be charged for the full repair or replacement costs of damaged property. In cases of intentional damage, the Operator reserves the right to take legal action.

14. Lost Property

The Operator will hold any lost property found on the premises for up to 10 days. If not claimed within that time, items may be donated to charity or discarded. The Operator is not responsible for any valuables left unattended.

15. Right to Refuse Admission

The Operator reserves the right to refuse entry to any User for reasons including, but not limited to, intoxication, inappropriate, uncivil, offensive, threatening or aggressive behaviour, or failure to comply with these Terms and Conditions.

16. Data Protection

The Operator complies with applicable data protection laws. Personal information collected during bookings is used solely for administrative purposes and will not be shared with third parties without consent. Users have the right to request access to, correct, or delete their personal data by contacting the Operator.

17. Equipment Hire Terms

Users renting equipment from the facility are responsible for returning it in the same condition. Any loss or damage incurred during use will result in additional charges. The Operator reserves the right to withhold further equipment hire until outstanding fees are paid.

18. Facility Etiquette and Attire

All Users must wear appropriate sportswear, including non-marking shoes. Users are expected to maintain good etiquette, respecting other Users, staff, and the facility. The Operator reserves the right to deny access to those not complying with this dress code or behaving inappropriately.

19. Rescheduling Due to Facility Issues

If the facility becomes unusable due to unforeseen events such as power outages,
equipment malfunctions, or maintenance, the Operator will offer alternative booking time slots based on availability as informed by the Operator. However, no further compensation will be provided beyond rescheduling.

20. Amendments to Terms and Conditions

The Operator reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to Users through the facility’s website or via email. Continued use of the facility after changes have been made constitutes acceptance of the new terms.

21. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Mauritius. Any disputes arising from their interpretation, application, or enforcement shall be subject to the exclusive jurisdiction of the courts of Mauritius. Users agree to submit to the jurisdiction of the Mauritian courts in any such dispute.

22. Penalties for Breach of Terms

22.1 Damage to Property or Equipment

If a User causes damage to the facility or equipment due to negligence, intentional misuse, or failure to comply with facility rules, the User will be liable for the full cost of repair or replacement of the damaged property. In addition, the Operator may charge a penalty of a minimum amount of Rs 10,000 for any administrative or operational disruption caused.

22.2 Misconduct or Violation of Rules:

Users engaging in inappropriate or dangerous behaviours may be subject to immediate expulsion from the facility without a refund. In addition, the Operator reserves the right to impose a penalty of a minimum amount of Rs 10,000 or suspend the User from future use of the facilities for a period of up to 12 months or, in severe cases, permanently.

23. Enforcement of Penalties

The Operator reserves the right to take legal action to recover any outstanding penalties or costs incurred due to breaches of these Terms and Conditions. Users who fail to pay penalties within 10 days of notification may face additional legal or administrative action, including interest charges or collection fees, without prejudice to all reasonable costs incurred in such recovery and the customary 10% commission for law practitioners.
